Welcome to the Siege Collectables website (the "Site"). The Site is owned and operated by Siege Collectables ("Siege Collectables," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Site, including any content, features, products, or services offered through it (collectively, the "Services").

By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Policies and Modifications

We reserve the right to update, modify, or replace these Terms, our policies, or any aspect of the Site at any time. Changes will be effective when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

3. Electronic Communications

When you use the Services or communicate with us electronically (including by email, text message, or through the Site), you consent to receive communications from us in electronic form. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

4. Intellectual Property

All content available through the Services—including text, images, graphics, logos, icons, audio clips, downloads, data compilations, and software—is owned by or licensed to Siege Collectables and is protected by United States and international copyright laws. The selection, arrangement, and compilation of all content on the Site is the exclusive property of Siege Collectables.

Trademarks

All Siege Collectables names, logos, and branding elements used on the Site are trademarks or trade dress of Siege Collectables. They may not be used in connection with any product or service that is not ours, or in any manner likely to cause confusion or imply endorsement, without our prior written consent. All other trademarks appearing on the Site are the property of their respective owners.

5. License and Permitted Use

Subject to your compliance with these Terms, Siege Collectables grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.

This license does not permit you to:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services for commercial purposes;
  • Collect or use product listings, descriptions, or pricing for the benefit of a third party;
  • Use data mining, scraping, robots, or similar data-gathering tools;
  • Frame or mirror any part of the Site without our express written permission;
  • Use our name, trademarks, or metadata without authorization.

All rights not expressly granted are reserved by Siege Collectables. Any unauthorized use automatically terminates the license granted herein.

6. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

Our products are intended to be purchased by adults. If you are under the age of 18, you may use the Services only with the involvement and consent of a parent or legal guardian.

Siege Collectables does not accept pre-orders. All products offered for sale are either in stock or listed as unavailable until inventory is received. We reserve the right, in our sole discretion, to refuse service, suspend or terminate accounts, remove or modify content, or cancel orders at any time.

7. Termination

We may terminate or suspend your access to the Site and Services at any time, with or without notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Site will immediately cease. Provisions that by their nature should survive termination—including payment obligations, disclaimers, and dispute resolution—will survive.

8. International Use

The Site is controlled and operated from the United States. We make no representation that the Services or products are appropriate or available for use outside the United States. If you access the Site from outside the U.S., you do so at your own risk and are responsible for compliance with local laws and regulations.

9. Risk of Loss

All purchases made through the Site are shipped pursuant to a shipment contract, as permitted under applicable law and Shopify commerce practices. Title to and risk of loss for items purchased pass to you upon our delivery of the items to the shipping carrier.

10. Returns, Refunds, and Title

Title to returned items does not pass to Siege Collectables until the items are received at our facility. In certain circumstances, we may issue a refund without requiring a return, in which case title to the refunded item remains with you.

11. Product Information and Pricing

We strive to provide accurate product descriptions, images, availability, and pricing through the Services; however, errors may occasionally occur. Product images are provided for illustrative purposes and may not reflect exact packaging or minor manufacturing variations.

If a product is listed with an incorrect price or incorrect information due to typographical, technical, or supplier error, Siege Collectables reserves the right to cancel or refuse any order placed for that product. If payment has already been processed, a refund will be issued to the original payment method.

12. Returns and Refunds Policy

Eligibility for Returns

Returns are accepted only if authorized by Siege Collectables in advance. To request a return authorization, you must contact our customer support team within 7 calendar days of delivery. Unauthorized returns may be refused or returned to the sender at the customer’s expense.

To be eligible for a return, items must be returned in the exact same condition in which they were sold, as determined by Siege Collectables upon inspection. This includes:

Item remains unused and unopened;

  • Original manufacturer seals (if applicable) remain intact;
  • Original packaging, inserts, and accessories are included;
  • No additional wear, damage, markings, odors, or alterations of any kind;
  • Item is packaged securely to prevent damage during return transit.

Any item that does not meet these standards may be denied a refund or subject to partial refund at our discretion.

Non-Returnable Items

The following items are not eligible for return or refund:

  • Opened, used, or altered products;
  • Items returned in a condition different from how they were sold;
  • Items with damaged, missing, or modified packaging;
  • Clearance, final sale, or marked "as-is" items;
  • Digital products or gift cards;
  • Products damaged due to improper handling after delivery.

Collectible-Specific Returns

Due to the nature of collectible merchandise, minor packaging imperfections (including shelf wear, creases, corner dings, or manufacturer-applied stickers) do not qualify as defects and are not valid reasons for return. Manufacturing variations in paint application, sculpt, or assembly are considered normal and are not grounds for return.

Returns based on packaging condition will only be accepted if the item was explicitly described as "mint" or "near-mint" and does not meet that stated condition upon arrival.

Damaged or Incorrect Items

If your order arrives damaged due to shipping or you receive an incorrect item, you must notify us within 48 hours of delivery and provide clear photographic evidence of the damage, including the shipping box and packaging. Failure to do so may void eligibility for replacement or refund.

Refunds

Approved refunds will be issued to the original payment method after the returned item is received and inspected. Original shipping charges are non-refundable. Return shipping costs are the responsibility of the customer unless the return is due to our error.

Refused or Undeliverable Shipments

Orders refused at delivery or returned to us due to incorrect or incomplete shipping information may be subject to return shipping fees and restocking fees, which will be deducted from any refund issued.

13. Disclaimer of Warranties

THE SERVICES AND ALL CONTENT, PRODUCTS, AND MATERIALS PROVIDED THROUGH THE SITE ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE STATED IN WRITING. SIEGE COLLECTABLES MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIEGE COLLECTABLES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR LIABILITY, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.

14. Dispute Resolution and Arbitration

We encourage customers to contact our customer support team first to attempt to resolve any concerns informally.

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any products purchased through the Services shall be resolved on an individual basis through binding arbitration, unless otherwise prohibited by applicable law. The arbitration shall be conducted in the State of Ohio, United States, and administered by a recognized arbitration organization in accordance with its applicable rules.

You and Siege Collectables agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. Each party knowingly and voluntarily waives the right to a trial by jury.

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent unauthorized use of the Services.

15. Governing Law

These Terms and any dispute or claim arising out of or relating to them, the Site, or the Services shall be governed by and construed in accordance with the laws of the State of Ohio and applicable federal laws of the United States, without regard to conflict-of-law principles.

16. Shopify Platform Disclaimer

The Site is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell products and services to you. Shopify is not responsible for the content, accuracy, or availability of the products offered through the Site.

17. Collectible Condition Disclaimer

Many items sold by Siege Collectables are collectible, limited-edition, or manufacturer-sealed products. Condition assessments are inherently subjective. Unless explicitly stated otherwise, items are sold as new and unopened but may exhibit minor cosmetic imperfections to packaging, including but not limited to shelf wear, corner dings, creases, tape residue, or manufacturer-applied stickers.

Packaging condition is not guaranteed and is not considered a defect unless the product listing specifically states that the item is sold as "mint" or "near-mint" condition. Minor variations in paint application, assembly, or finish are considered normal and are not grounds for return or replacement.

By purchasing collectible items from Siege Collectables, you acknowledge and accept these condition standards.
